1. Introduction

Welcome to CareKindle (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our mobile application (the “App”), the waitlist sign-up for the App, and any related services provided by CareKindle (collectively, the “Services”). By signing up for the waitlist, submitting an inquiry, or using the App, you agree to be bound by these Terms.

2. Eligibility

You must be at least 13 years old to use our Services. By signing up for the waitlist, submitting an inquiry, or using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have your parent or guardian’s permission to use the Services.

3. Account Registration and Waitlist Sign-Up

To access certain features of the App or to sign up for the waitlist, you may be required to register for an account. When you register or sign up, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Service Inquiries

By submitting an inquiry for services through our designated form, you agree to provide accurate and complete information. We will use this information to respond to your inquiry and provide relevant information about our services. Submission of an inquiry does not obligate you to use our services, nor does it create a service contract between you and us.

5. Use of the App and Services

You agree to use the App and Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App or Services in any way that violates any applicable local, national, or international law or regulation.
  • Engage in any activity that is harmful, fraudulent, deceptive, or otherwise objectionable.
  • Attempt to gain unauthorized access to the App, other users’ accounts, or our computer systems or networks.

6. Intellectual Property

All content and materials available on the App and through the Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of CareKindle or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

Your use of the App and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

8. In-App Purchases

The App may offer in-app purchases. If you choose to make a purchase, you agree to provide accurate and complete payment information. You authorize us to charge the applicable fees to your payment method. All in-app purchases are final and non-refundable, except as required by law.

9. Termination

We reserve the right to terminate or suspend your account and access to the App or Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or us.

10. Disclaimer of Warranties

The App and Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the App or Services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App or Services will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the App or Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App or Services by any third party; or (d) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App or Services.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Jersey, USA, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in New Jersey, USA to resolve any dispute arising out of these Terms, the App, or Services.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the App or through other communications. Your continued use of the App or Services after the changes become effective constitutes your acceptance of the revised Terms.
