Terms of service

These are the terms between CareKindle and the home-care agency that subscribes (that’s “you”). They are written to be read. If anything here is unclear, write to hello@carekindle.com and we will explain it in plainer language still.

By creating an account or using CareKindle, you agree to these terms.

What CareKindle is

CareKindle is subscription software for home-care agencies: scheduling, visit verification, client and caregiver records, care plans and assessments, client billing, payroll timesheets, messaging, reports and a compliance centre. We provide the software; you provide the care. CareKindle is not a health-care provider, and nothing in the product is medical advice.

Where the product offers AI assistance, it is suggestion-only and optional: a person on your team reviews and decides. The software never makes a clinical decision.

Your account

  • Keep your account information accurate and your credentials to yourself.
  • You decide who on your team gets access and at what role. There are six operator roles, plus separate caregiver and family-portal access. You are responsible for what your authorized users do in your account.
  • Tell us at hello@carekindle.com if you believe an account has been compromised.

Subscriptions, pricing and the trial

CareKindle is priced per client seat: Starter at CA$19, Core at CA$15 and Growth at CA$12 per client seat per month, with per-plan client-seat minimums (Starter 8, Core 20, Growth 50), plus a custom Enterprise plan for larger agencies. Annual billing takes 20% off those rates. All prices are in CAD. Current details are on the pricing page.

A client counts as active while your agency is onboarding, serving or managing them (intake through active service, including on-hold and hospitalized, and post-service record-keeping), until the file is archived. Prospects, waitlisted clients and archived files never bill.

Every account starts with a 14-day free trial: full access, no credit card. If the trial ends before you pick a plan, your account becomes read-only. Your data stays viewable, and everything unlocks again when you subscribe.

Your subscription is billed by Stripe. CareKindle never charges your clients or their families. Client invoicing is yours, issued by you, in your name.

If a payment fails, we do not lock you out mid-shift: you keep access for a grace period while you sort out the payment method. If you cancel, your plan runs to the end of the period you paid for.

Taxes are added where applicable.

Health information

Your agency is the health information custodian (or the responsible organization in your province) for the client records you keep in CareKindle. We process those records only on your behalf and only to provide the service. Our role and our safeguards are described in the privacy policy and on the security page.

You confirm that you have the legal authority and any necessary consents to put the information you upload into CareKindle.

Acceptable use

  • Use CareKindle only as the law allows.
  • Do not probe, bypass or test the boundaries between agencies’ data, or try to access records that are not yours to see.
  • Do not upload content you have no right or authority to store.
  • Do not resell access to CareKindle or interfere with the service’s operation.

We may suspend or close accounts for serious or persistent misuse. We will tell you why.

Your data

The records you keep in CareKindle are yours. We use them only to provide the service. You can export your reports and your accounting data (QuickBooks CSV export) at any time while subscribed, and if you leave, we will provide reasonable assistance retrieving your records.

Service changes and availability

We maintain and improve CareKindle continuously, and features may change over time; we will tell account owners about material changes. We work hard to keep the service available, but we are a young company and do not publish an availability percentage we have not yet earned the history to back. The service is provided “as is” and “as available”, without warranties beyond those the law implies and cannot exclude.

Limitation of liability

To the extent the law allows: CareKindle is not liable for indirect or consequential losses (lost profits, lost data not caused by us, business interruption), and our total liability for all claims in any 12-month period is capped at the subscription fees you paid us in those 12 months. Nothing in these terms excludes liability that cannot be excluded under applicable law.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction over disputes.

Changes to these terms

We may update these terms. Every revision is dated at the top of this page, and material changes will be flagged to agency account owners before they take effect.
